Philips CPAP Machine Recall - Guardian Legal Network

Despite these health benefits, one of the market leaders, Philips, issued a recall for certain CPAP, BiPAP, and APAP devices due to toxic sound absorption foam. This foam has since been linked to dozens of injuries and cancers with potentially millions of victims spread across the country.

Philips CPAP Recall

Philips recalled a number of their ventilators in June 2021. The polyester-based polyurethane (PE-PUR) foam used to reduce sound and vibrations was discovered to break down and pieces of chemicals could be directly inhaled by users as they slept. The result would be serious injuries that would require medical intervention to prevent greater damage.

The recalled devices produced from 2009 to 2021 are:

Garbin Plus, Aeris, LifeVent (ventilator)
OmniLab Advanced+
REMstar SE Auto
SystemOne ASV4
SystemOne (Q-Series)
Trilogy 100 (ventilator)
Trilogy 200 (ventilator)

Anyone who used or uses any of these devices is urged to speak with their healthcare provider immediately to discuss alternative ventilators or perform a check-up to prevent new or further injuries.

Associated Injuries

Numerous injuries including severe cancers have been linked to Philips CPAP machines and the PE-PUR foam. While the exact number of victims remains unknown, the popularity of CPAP machines suggests there are potentially millions spread across the nation. Settlements

Since the recall in 2021, Philips has faced thousands of lawsuits over their defective CPAP machines. Despite this, no settlements were made until 2023.

The Dutch multinational conglomerate announced they were setting aside 575 million euros, or $615 million, for the estimated economic loss of a settlement in early 2023. By this point, hundreds of personal injury claims had been filed against the company, all seeking compensation for their growing medical costs for current and future care.

Later in September, Philips announced they struck a deal to settle the lawsuits with an initial payment of $479 million fund. Despite the large fund, Philips stated payments will vary between claimants depending on the type of device they used.

Even with these settlements, the proposed payments divided among thousands of claims is unfortunately likely to not amount to much for most victims. But litigators are still fighting and pursuing justice for victims taking part in this mass tort litigation. Even if these settlements may be divided amongst thousands of claimants, they show Philips is willing to compensate victims for their injuries and may be a sign of things to come as more and more people come forth to hold the company accountable.
